Terms of Service

These terms are an agreement between you and the developer and operator of echo agent (“we”, “us”). They cover the echo agent app, the echo model service, your account and our website. By downloading, signing in to or using echo agent you agree to them and to the Privacy policy. If you don’t agree, don’t use echo agent.

1. The service

echo agent is a voice assistant for the Mac. It can answer questions and act on your Mac: read and write files, run commands, capture windows you ask about, and start tasks in tools such as Codex and Claude Code. It can use either echo, the model service we provide after you sign in, or a model provider you configure with your own API key. echo agent is under active development; features may change, be limited or be removed at any time.

2. Your account

• You must be at least 14, and old enough to agree to these terms where you live, or have a guardian’s consent.
• Give accurate sign-in details and keep access to your email, phone, Google or WeChat account and your Mac secure. You are responsible for everything done with your account.
• One account is for one person. Don’t create accounts in bulk, share, sell or transfer accounts, or sign in as someone else.
• Tell us promptly if you think someone else is using your account.

3. The echo quota and passes

• Signed-in accounts get a limited number of free echo requests each day, which resets at midnight Beijing time. One request is one thing you ask; the steps echo takes to finish it are included, but very long or costly tasks may use up the day’s quota sooner.
• The free quota is a trial, provided at our discretion. We may change the amount, the rules for counting it, the models behind it and its availability, or pause or end it, for everyone or for particular accounts or Macs, at any time and without notice.
• The quota applies per account and per Mac. It has no cash value and cannot be transferred, carried over or exchanged.
• Getting more free use by creating several accounts, changing device identifiers, automating requests, reselling access, or otherwise getting around the limits is prohibited and may lead to suspension.

Passes.

• A pass is a one-time purchase. While it lasts (for example 30 days) your account gets more echo uses each day. The number of days, daily uses and price are those shown when you buy. A pass does not renew automatically; when it ends you go back to the free quota. Buying the same plan again adds its days after the current end date.
• Payments are processed by Stripe, by card in US dollars or by WeChat Pay or Alipay in Chinese yuan. We never receive or store your card or payment account details. Prices, including limited-time yuan prices, may change at any time; changes don’t affect passes already bought.
• A pass belongs to the account that bought it and cannot be transferred. Daily uses reset at midnight Beijing time and unused uses don’t carry over. Very long or costly tasks may use up the day sooner, and the per-day cost limit still applies. Pausing the free quota doesn’t affect passes.
• A pass starts working as soon as it is paid for and is a digital service already delivered, so it is not refundable on request, except where the law requires otherwise. If you were charged twice, paid but the pass didn’t turn on, or couldn’t use echo for a long time because of us, contact us through Send Feedback; after checking we will refund or make it up to you. A refunded pass ends immediately.
• If your account is suspended for breaking these terms, the unused part of a pass is not refunded, except where the law requires otherwise. If we stop providing echo, we will refund the unused days of active passes in proportion.

4. Acceptable use

You must not use echo agent, directly or through its tools, to:

• break any law, including laws on generative AI, data protection, intellectual property and export control;
• create or spread content that is illegal, harmful, fraudulent, defamatory, harassing, sexual content involving minors, violent extremism, or that infringes others’ rights;
• access systems, accounts or data you aren’t authorized to access, or develop or spread malware;
• attack, overload, probe or disrupt our servers, bypass authentication or quotas, or reverse engineer, scrape or resell the echo service;
• use echo to build a competing model or service, or pretend AI output was written by a person where that would mislead.

We, or the model provider, may refuse, filter or stop requests that appear to break the law or these terms.

5. AI output

Answers and actions are generated automatically by AI models and can be wrong, incomplete, out of date or inappropriate. They are not professional advice (legal, medical, financial or otherwise). Check anything important before relying on it. You are responsible for how you use the output, including anything you publish or send.

6. Actions on your Mac

echo agent acts with your macOS permissions. It can change or delete files, run commands, and start tasks in other tools that may themselves change files or send data. Its working folder is not a sandbox. You decide which permissions to grant and whether tools run automatically or ask for approval first, and you are responsible for reviewing what it does. Keep backups of important data. To the fullest extent the law allows, we are not responsible for data loss, damage, charges or other consequences of actions carried out at your request or under the approval settings you chose.

7. Third-party services

echo agent works with services we don’t control: the model provider behind echo, the provider of your own API key, Codex, Claude Code, ChatGPT, Claude, Google, WeChat, and our email and SMS providers. Their terms and privacy policies apply to your use of them, you are responsible for any fees they charge, and we are not responsible for their availability, content or conduct.

8. Your content

You keep your rights in what you send and in the output you receive, to the extent the law allows. You give us and our service providers permission to transmit and process it as needed to provide echo agent, as the Privacy policy describes. You confirm you have the rights and permissions needed for what you send, including other people’s personal information.

9. Our rights

echo agent, its name, design, code and website are ours or our licensors’. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose under these terms. Open-source components are covered by their own licences. If you send us feedback or suggestions, we may use them freely without obligation to you.

10. Suspension and ending

You can stop using echo agent and ask us to delete your account at any time. We may suspend or end your access to echo, your account or the service, in whole or in part, with or without notice, if we believe you have broken these terms, to prevent abuse, fraud or harm, when the law requires it, or if we stop providing the service. Sections that by their nature should continue, including 5 to 9 and 11 to 14, continue after access ends.

11. No warranties

echo agent and echo are provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties of any kind, express or implied, including that the service will be uninterrupted, error-free, secure, accurate or fit for a particular purpose, or that data will not be lost.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill or business opportunities, arising from or related to echo agent, however caused. Our total liability for all claims related to echo agent is limited to the amount you actually paid us for the service in the 12 months before the claim. If you have only used free features, that amount is zero. None of this limits liability that cannot be limited by law.

13. Indemnity

To the extent the law allows, you will compensate us and our service providers for claims, losses and reasonable costs (including legal fees) arising from your breach of these terms, your content, or your misuse of echo agent.

14. Changes, law and contact

• We may change these terms. We update the date at the top and, for significant changes, tell you in the app or on this website. If you keep using echo agent after a change takes effect, you accept the updated terms.
• These terms are governed by the laws of the People’s Republic of China, excluding its conflict-of-laws rules. Disputes should first be resolved through negotiation; failing that, they go to a competent court where we are located, unless the law of your place of residence requires otherwise.
• If any part of these terms is unenforceable, the rest remains in effect. Our not enforcing a term is not a waiver.
